WV Water Contamination Settlement and Public Benefits


Water Settlement Checks went out in mid-September.  During that time, Legal Aid set-up a phone line for individuals to call to obtain information on how this check may affect their SSI (Supplemental Security Income) or DHHR Benefits, such as SNAP,  WV WORKS, Medicaid, or CHIP.   The Water Settlement Check should not affect your SNAP, WV WORKS, Medicaid, or CHIP benefits in the month when you receive the money.  If you filed a “simple claim,” the Water Settlement Check should not affect your SSI benefits in the month when you receive the money.  You must report the payment to DHHR; if you receive SSI, you must also report to Social Security.  This must be reported within 10 days after getting the check.  Please remember that if the check arrived in September, any money you have in cash or bank account on October 1st will be counted against your asset limit.  If either your cash or bank account on the first of the month puts you over the asset limit, you will not be eligible for benefits in October.  If you receive a notice from DHHR  and/or the Social Security Administration that you are over your asset limit for your benefit and your check is being reduced or they are claiming an overpayment has been made, and you believe this is a result of the Water Settlement Check, our hotline remains open to assist you.  You can reach us at 1-877-331-4259.
