On June 24, 2019, the West Virginia Legislature passed House
Bill 206, the omnibus education bill. One of the many things that this
bill addressed was the creation of a process to establish West Virginia’s first
three public charter schools. The new law allows that the first three
public charter schools can begin operating in the 2021-2022 school year.
It is important to remember that public charter schools are
public schools and are still required to follow the Individuals with
Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act of
1973, and the Americans with Disabilities Act (ADA).
