Accessing Assistive TechnologyThrough the IDEA
- The Individuals with Disabilities Education Act (IDEA), found in Volume 20 of the United States Code (U.S.C.) at Sections 1400 and following, was enacted in 1975 and is one of the federal laws that authorizes special education and related services, including assistive technology. The federal regulations that help to specify the requirements of the IDEA can be found in the Code of Federal Regulations (C.F.R.) in Volume 34, Part 300.

Obligations of State and Local Colleges and Universities to Deaf
- State and local colleges and other post-secondary institutions have obligations under two federal laws to provide effective communication with their students and other individuals who are deaf or hard of hearing. Colleges or universities which receive any form of financial assistance or loans, for the institution or for students attending the institution, are federal financial
recipients pursuant to Section 504 of the Rehabilitation Act of 1973, 29 U.S.C.
Š794, as amended. The receipt of that funding by any component of the institution requires every program within the institution to comply with the civil rights requirements imposed by the receipt of federal funding. Civil Rights
Restoration Act of 1978, 29 U.S.C. Š794(b).

Post Secondary Education
- Discrimination in post-secondary education (i.e., colleges, universities, and trade schools) is prohibited by federal laws: Section 504 of the Rehabilitation Act (Section 504) and the Americans with Disabilities Act (ADA). This handout provides general information about Section 504 and the ADA but is not intended to and does not replace an attorney's advice or assistance. Do not take any action based only upon this handout; always consult with an attorney first.

Public School Obligations to Deaf Individuals
- This memorandum addresses the obligations of a public school system under
Section 504 and the Americans with Disabilities Act. Deaf students, parents and
personnel are entitled to a physically accessible facility and to services including
qualified sign language interpreters when they need accommodations to have
meaningful access to school activities. The ADA and Section 504 apply to all
programs and activities offered by a school system, including school board
meetings, extracurricular programs, teacher conferences, recreational activities,
social and cultural activities, adult education, summer school or hobby classes.

State Special Education Regs
- These policies and procedures apply to preschool, early childhood, middle childhood, adolescent and adult students whose educational programs require special education and related services. These apply to three year olds, as of their third birth date, through five year olds with disabilities, students with disabilities ages five through twenty-one, all exceptional gifted students in grades nine through twelve and to all gifted students in grades one through eight as specified. Rights under these regulations cease to apply at the end of the school year in which the student turns twenty-one years of age, that is, the year in which the student is twenty-one years of age prior to September 1 or the student has met graduation requirements for a standard high school diploma.

Summary of Policy 2419 revisions
- Policy 2419 establishes the regulations for compliance with the federal Individuals with
Disabilities Education Improvement Act 2004 (IDEA 2004) and West Virginia State Code,
Chapter 18, Article 20 regarding provision of services to students with exceptionalities. Final
regulations to implement IDEA 2004 became effective October 13, 2006 and include procedural
changes for programs and services. This necessitates revisions to West Virginia Board of
Education Policy 2419 in order for the State to demonstrate its compliance with federal law and
ensure receipt of federal funding.
